Terms of Use

These terms govern use of the Müşterify website and cloud-based customer management platform. By accessing the site, using it, and/or starting to use our products and services, you are deemed to accept these terms.

Scope of the service

Müşterify is a software service providing customer and appointment management, automated reminders, messaging and reporting. Which modules are enabled depends on your plan and your request.

The service is not a medical device or a clinical decision support system. Information held in the platform is not a substitute for diagnosis, treatment or legal advice; responsibility for professional decisions rests entirely with the user.

Your account and responsibilities

You are responsible for the confidentiality of your account details and password. Tell us immediately if you notice unauthorised access.

You are responsible for the permissions you grant your team and for the actions of your team members.

You are the data controller for the customer, patient and client data you enter into the system. You confirm that you have the necessary legal basis, and explicit consent where required, to collect and process that data.

Ensuring that recipients of automated messages and reminders have agreed to receive them is your obligation.

Prohibited uses

You may not use the service for unlawful purposes, to send unsolicited bulk messages, in a way that infringes the rights of others, to test or circumvent system security, to reverse engineer it, or to place excessive load on it with automated tools.

Availability and maintenance

We make reasonable efforts to provide the service without interruption, but uninterrupted access is not guaranteed. We try to announce planned maintenance in advance. You can follow current status on our status page.

Fees

Fees are determined by the plan you choose and are set out in your agreement with us. Fee changes are notified a reasonable time before they take effect.

Suspension and termination

We may suspend or terminate your account in the event of a serious breach of these terms, failure to meet payment obligations, or use that threatens system security. Where possible we give notice first.

You may close your account at any time. After closure you have 30 days to export your data; at the end of that period the data is deleted or anonymised.

Intellectual property

All rights in the software, interface, brand, logo, text and images belong to Müşterify or the relevant rights holders. You are granted only the right to use the service; no right to copy, reproduce or create derivative works is given.

The data you enter into the platform belongs to you. We hold only the processing rights needed to deliver the service.

Limitation of liability

The service is provided "as is". To the maximum extent permitted by law, we are not liable for indirect damages, loss of profit, loss of data or business interruption. In any event our total liability is limited to the amount you paid us in the 12 months preceding the claim.

These limitations do not affect liability arising from intent or gross negligence, nor any consumer rights that cannot be excluded by contract.

Changes

We may update these terms. We notify significant changes before they take effect; continuing to use the service after notice means you accept the current terms.

Governing law

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of the Republic of Türkiye have jurisdiction over disputes. If you are acting as a consumer, your right to bring proceedings in the courts of your place of residence is reserved.
